Terms of Service
These terms cover how you can use the ByteForge website and our products, including SparkTrack. They're a working draft and will be finalised with legal counsel before launch. By using our services, you agree to what's set out below.
Agreement
These terms are an agreement between you and Byte Forge Technologies L.L.C (“ByteForge”), a company licensed in Dubai, United Arab Emirates (Commercial Licence No. 1256204). If you're using our services for a company or agency, you're confirming you have the authority to accept these terms on its behalf.
Use of our services
We grant you a limited, non-exclusive, non-transferable right to access and use our services for their intended purpose. Some products are governed by a separate service agreement, which takes precedence where it conflicts with these terms.
Accounts & access
Where a product requires an account, you are responsible for keeping your credentials secure and for activity that takes place under your account. Tell us promptly if you believe your account has been compromised.
Acceptable use
You agree not to misuse our services. In particular, you must not:
- Attempt to disrupt, probe, or gain unauthorised access to our systems.
- Use the services to break the law or infringe the rights of others.
- Resell or expose the services in ways not permitted by your agreement.
Intellectual property
ByteForge and its licensors retain all rights in the services, including software, branding and content, except for rights expressly granted to you. You retain your own data and content.
Disclaimers
Our services are provided on an "as is" and "as available" basis. To the extent permitted by law, we disclaim implied warranties and do not guarantee that the services will be uninterrupted or error-free.
Limitation of liability
To the maximum extent permitted by law, ByteForge will not be liable for indirect, incidental, or consequential damages arising from your use of the services. Nothing in these terms limits liability that cannot be limited by law.
Changes to these terms
We may update these terms from time to time. When we make material changes, we will revise the date at the top of this page and, where appropriate, provide additional notice.
Governing law
These terms are governed by the laws of the United Arab Emirates, as applied in the Emirate of Dubai. Any dispute we can't resolve between us will be subject to the exclusive jurisdiction of the courts of Dubai.
